Objectives of Shari’a, Capacity and Dimensions

Ijtihad based on objectives of Sharia’h has been focused specially in the
present age. The thing of special importance is that whether objectives of
Shari’a are possible in all types and areas of Shari’a or is it reliable under
specific circumstances. It is admitted that the authenticity of objectives of
Shari’a is not valid for clear cut commandments of Shari’a as mentioned in the
four basic sources of Shari’a. Although under exceptional circumstances,
especially in the matter of dire needs, objectives of Shari’a are also authentic.
Ijtihad based on Objectives of Shari’a and its validity, it is divided according
to its uniqueness and flexibility. And in case of unique commandments, Ijtihad
based on Objectives of Shari’a is not possible. However in other flexible
commandments, objectives of Shari’a may be effective.
But it should be given due consideration in case of application of
objectives of Shari’a, that they affect the commandments of Shari’a in many
ways. It is therefore, various religious scholars have divided the objectives of
Shari’a in multiple ways. Because it is necessary in legislation process,
especially in personal issues but these different divisions are described by
religious scholars for comprehension purpose only. Therefore, the application
of the objectives of Shari’a on commandments of Shari’a is a very difficult
task that can only be performed by a highly expert Mujtahid
