Begning & Evolution of Ijtihad in Ja’fari Fiqh

This article discusses the evolutionary stages of Ijtihad (ultimate effort) in Ja’fari school of jurisprudence. According to the author, the term “Ijtihad” in its first stage, was considered as a synonym of “Qiyas” (analogic reasoning), which was rejected by Ahl al-Bayt and Shia Ulama. Later on, Muhaqqiq Hilli, while rejecting Qiyas, accepted Ijtihad as where more deliberation and effort were required to understand the Nas (explicit proof). In the later stage, it was accepted that the deduction of rulings from explicit proof also required the acceptance of some rules. It was in this way that it was also called ijtihad. In the final stage, the debate on the authority and application of principles to infer the apparent command in the absence of explicit proof and non-access to the actual command also became known as Ijtihad.
