TEMPORARY MARRIAGE IN THE VIEW OF THE SAHIHAYN (SAHIH BUKHARI & MUSLIM) & FARIQAYN (SHIA AND SUNNI)
Abstract
Temporary marriage or muta’h refers to taking a woman in marriage for a specific time period. This kind of marriage takes place only among the Shia Muslim. Other non-Shia Muslims not only express their disdain for it, sometimes they also criticize Shia Muslims for observing muta’h. In the Hanbalite School of Sunni Jurisprudence, there is a type of marriage, called Nikah al-Misyār (lit. traveller’s marriage or marriage of convenience), which is identical to muta’h. In this article, some aspects of muta’h has been discussed in the light of Shia Jurisprudence, and especially in the view of the Sahihayn. The authors claim that the temporary marriage involves all the conditions of a permanent marriage and it is completely legal from the viewpoint of Islamic laws.
