The Legal Status of Fine and its Contemporary Importance in Perspective of Opinion of Four Imams (Jurists)
Abstract
For the betterment and bringing peace and prosperity in the human society,
alongside the preaching of goodwill, the most essential thing is the implementation
of the concept of punishment and reward, i.e. punishment by thrashing, by scolding,
by arresting and sometime by imposing fines. The religious scholar of four schools
of thought are agree on the entire three first one, but on imposing of fine or wealth
penalties none was in favor of this kind of punishment. Later on several religious
scholars like Imam Abu Yousaf, Imam Ibn e Taimiyya and Imam Ibn e Qayyem
give their verdicts on the penalty related to money or fines. Now a day imposing
huge fines are used for the prevention crimes throughout the world. Penalty on
utility bills or indemnity from the criminals shows that everyone agrees on the
imposing of fines on the criminals, We don’t find any clear evidence of the imposing
fine on the verses of Qur’an and Sunnah, but looking at some example of Qu’ran
and Sunnah and the lives of the companions (Saḥaba مہنع اہلل ریض)of the Holy prophet
(صلى الله عليه وسلم ,(we can conclude some instances that the system of financial punishment was
present in different shapes. This research will help to find all such instances.
