Abstract
Crime is fatal and dangerous for any society, especially those
Crimes which are transitory and jointly committed.
Therefore, to develop and maintain a peaceful and model
society and to stop crimes, Islam stresses and gives great
importance to self-purity (personal reformation) and to the
duty to enjoin the people to do good and to prevent them
from doing bad. The given article critically discusses the
punishment of that crime, which is the outcome of joint
efforts, in order to determine the real culprit and the
supporter (facilitator) in the light of Islamic Jurisprudence.
Basically (mainly) it discusses clause 109 of the govt Act,
having the title: Similar punishment for the culprit and
facilitator. So, an attempt has been made to prove with
arrangements that punishment for both is not similar as per
Islamic Jurisprudence.
