Abstract
Issues about which the Shari'ah does not state any decisive and categorical order,
such as the Shari'ah does in liquor, interest, adultery, etc. rather by keeping in view
their ease and convenience it gives them a prospective stance and statement in terms
of flexibility and convenience. So, in such matters, the consultation in the opinion of
the jurists is that what Shari'ah intends in order to meet the needs of time. But it is
important that this decree be based on the will of the Shari'ah for general public
purposes, rather than by a selfish desire, and in their implication, there should be
nothing wrong in the interpretation of basic principles of Shari'ah. Jurisprudence is
referred to numerous opinions a certain definite opinion takes the status of Maḍhab,
sometimes inter-religious second opinion and sometimes external opinion may also
have the status of religion, but in this case the coherence of principles relevance is
very important because a system of principles lies behind the opinions, it is
absolutely necessary to accept a stranger's opinion and to reconcile it with the
remaining principles, otherwise a contradiction, feasibility and ambition will arise.
